Christian Louboutin Vs. Yves Saint Lauren

I was watching CNN just now & I came across this very interesting story. As a law student & aspiring Entertainment Lawyer I decided to analyze the situation & here is the scoop.

French shoe designer Christian Louboutin filed a lawsuit against Yves Saint Laurent  (YSL) for trademark infringement and requested an injunction against YSL.

Under the suit, Christian filed that YSL’s Cruise Collection 2011 included four shoe designs with his trademark Red Soles. Last month, a U.S. District Court judge, Victor Marrero denied the injunction & ruled in favor of the defendant, Yves Saint Laurent. Judge Victor Marrero stated that while Christian Louboutin owned the trademarked Red Sole his request to halt production was far reaching. He explained, “Louboutin’s claim to ‘the color red’ is, without some limitation, overly broad and inconsistent with the scene of trademark registration.”  He also stated that fashion is a highly creative industry and that the designers should not be prohibited from using the colour red.

In my opinion, I think that his decision contradicts with the ability to trademark a colour. Why make it possible to trademark the colour if this trademark will not be honored in the Court of Law.  In my opinion, the ruling will result in some high-end problems in the high-end world of fashion.
